Terms of Service

These Terms form a binding agreement between you and Codicore Private Limited. By accessing the Service, creating an account, or purchasing a plan, you accept these Terms and the policies incorporated by reference. If you use Kickva for an organization, you represent that you may bind it. You must be legally capable of contracting; minors may use the Service only with a parent or lawful guardian’s permission and supervision.

Kickva provides browser-based AI, media, document, developer, and utility tools. Some features run locally; others require network services. Features, limits, models, supported formats, and availability may change as technology and provider costs evolve.

You must provide accurate account and purchase information, keep credentials confidential, and promptly report unauthorized use. You are responsible for activity under your account except to the extent caused by our breach. We may require verification or refuse misleading, abusive, or duplicate accounts.

You may use the Service only lawfully. You must not:

• infringe copyright, trademark, privacy, publicity, contractual, or other rights;
• remove watermarks, access public-profile media, or process content unless you own it or have clear permission and a lawful purpose;
• create or distribute unlawful, deceptive, abusive, exploitative, hateful, violent, defamatory, privacy-invasive, or illegal sexual material;
• impersonate others, facilitate fraud, evade academic or professional integrity rules, or misrepresent AI output as verified fact;
• upload malware, secrets you may not disclose, or content designed to attack models, systems, or other users;
• scrape, overload, disrupt, reverse engineer except where law expressly permits, bypass limits or payment controls, share paid access outside its allowed scope, or probe security without written authorization;
• use outputs to make fully automated high-impact decisions about employment, credit, housing, healthcare, legal rights, or safety without qualified human review.

You retain ownership of content you submit and outputs you lawfully create, subject to third-party rights and applicable law. You grant Codicore a limited, non-exclusive licence to host, transmit, reproduce, transform, and display content solely as needed to provide, secure, support, and improve the requested Service. This licence ends when the content is deleted, except for lawful retention, backups, and content separately submitted through an explicit improvement opt-in.

You represent that you have all rights and permissions needed for submitted content and instructions. We do not endorse, verify, or pre-clear user content or outputs.

AI output, transcription, conversion, enhancement, detection, generation, and other results can be inaccurate, incomplete, non-unique, biased, or unsuitable. Review outputs and maintain backups before replacing original files. Do not rely on Kickva as legal, medical, financial, safety, or other professional advice. You are responsible for checking facts, licences, permissions, quality, and fitness before publication or use.

Free allowances and paid entitlements are described on the pricing page and may vary by tool. Current launch plans are prepaid for the displayed period and do not automatically renew unless you separately and expressly authorize a recurring mandate in the future.

Prices are displayed in INR unless stated otherwise. Taxes, gateway requirements, and final payable amount are shown before payment. Razorpay processes payment credentials under its own terms. Access begins only after Kickva verifies an exact captured payment. You may not manipulate checkout data, signatures, receipts, entitlements, or usage records.

Refund eligibility and processing are governed by our Refund Policy. Statutory consumer rights remain unaffected.

The Service, software, interfaces, branding, documentation, templates, and original content are owned by Codicore or its licensors and protected by law. These Terms grant only a limited, revocable, non-transferable right to use the Service. They do not grant rights to source code, trademarks, datasets, models, or provider assets. Open-source components remain governed by their respective licences.

The Service may integrate AI providers, Razorpay, Google services, Cloudflare, public data sources, model repositories, and external links. Their availability and conduct are outside our control, and their terms may apply. Kickva is independent and is not endorsed by Instagram, Meta, OpenAI, Microsoft, Google, Razorpay, or another referenced platform unless expressly stated.

You may stop using the Service at any time. We may restrict or terminate access where reasonably necessary for security, legal compliance, non-payment, material breach, provider requirements, or harm to users or the Service. Where practical, we will provide notice and an opportunity to remedy. Provisions concerning ownership, payment, disclaimers, liability, disputes, and lawful retention survive termination.

To the extent permitted by law, the Service is provided “as is” and “as available”. We disclaim implied warranties of merchantability, fitness, non-infringement, accuracy, and uninterrupted availability. We do not exclude warranties or remedies that cannot lawfully be excluded.

To the maximum extent permitted by law, Codicore and its directors, employees, and providers are not liable for indirect, incidental, special, consequential, exemplary, or punitive loss; lost profits, data, goodwill, or opportunities; or losses caused by user content, third parties, or failure to keep backups. Our aggregate liability arising from paid Service use will not exceed the amount you paid to Codicore for the affected Service during the 12 months before the event. This cap does not apply where liability cannot legally be limited, including fraud, wilful misconduct, or certain personal injury and consumer claims.

To the extent permitted by law, you will defend and indemnify Codicore against third-party claims, losses, and reasonable costs resulting from your unlawful content, infringement of another person’s rights, misuse of the Service, or material breach of these Terms. This does not require you to indemnify Codicore for its own negligence, breach, or unlawful conduct.

These Terms are governed by Indian law. Before filing a claim, each party should send written notice and allow 30 days for good-faith resolution. Subject to mandatory consumer forums and other non-waivable rights, courts of competent jurisdiction in Hathras, Uttar Pradesh, India will have exclusive jurisdiction. Nothing prevents either party from seeking urgent injunctive relief or using a legally available consumer grievance process.

We may update these Terms for legal, security, operational, or product reasons. Material changes will receive reasonable notice where required. If any provision is unenforceable, the remainder continues in effect. Delay in enforcement is not a waiver. You may not assign these Terms without consent; Codicore may assign them as part of a merger, reorganization, or transfer of the Service. These Terms and incorporated policies are the entire agreement regarding the Service.
